I chose the following article for you to read because it is about a case being taken to the Supreme Court. We have learned in Social Studies that the Supreme Court will only hear cases they feel challenge the United States Constitution. When you comment tell me which Amendment this case will challenge. I want you to state your opinion on the matter, are the protesters going against our supreme law? I also find it interesting because the protesters are from Kansas, so close to home, this group is continuoulsy protesting funerals of our fallen soldiers around the United States.

John Ellsworth's son, Marine Lance Cpl. Justin M. Ellsworth, died in November, 2004, as a result of enemy action in Al Anbar Province, Iraq. John Ellsworth is a command sergeant in the Wolverine Lake Police Department in Michigan. His lawsuit with Yahoo! to recover his son's wartime e-mails made headlines in January and February of 2005. He is one of the founding members and chairman of Families United, a nonprofit organization that honors the fallen in war and supports their families. John Ellsworth is the man who wrote the following article.
(CNN) -- The recent ruling of a federal appeals court requiring the family of fallen hero Lance Cpl. Matthew Snyder to pay the legal expenses of Fred Phelps and his misguided followers at Westboro Baptist Church is unconscionable.
Like Matthew's father, Albert, I am all too familiar with the hardships associated with losing a son in combat, having lost my son Justin in 2004. It is a tragedy that the thanks given the Snyder family in return for the life of their son is a court order to repay the legal expenses of the hate group that protested at his funeral with signs such as "thank God for dead soldiers."
Beyond simply insulting though, this decision by the 4th Circuit Court of Appeals is a slap in the face for every Gold Star family that has lost a loved one in combat. It also represents an egregious misuse of the judicial system; one that sets a dangerous precedent for how the memory of our fallen heroes will be treated. The Supreme Court should immediately move forward with this case and stand up for those who have stood in the face of danger for all Americans.
The legal maneuvers that brought Albert Snyder and his family to this point are enough to make any American shake his or her head in disgust. After Snyder lost his life in 2006, Fred Phelps and his followers showed up at his funeral to spread their message of hate.
Mind you, they didn't know Matthew, and thus had no understanding of the enormous sense of loss his family was feeling; they simply decided that the Snyder family's vulnerability presented an easy platform for their own agenda.
To his credit, Albert Snyder sued the group and won an $11 million judgment against them. However, that award was reduced to $5 million on one appeal and overturned altogether this week by the appeals court.
In fact, not only did the court overturn the original ruling, but it decided to add to the pain and suffering of the Snyder family by imposing more than $16,000 of court fees. Perhaps the judges had forgotten that without the sacrifices of brave soldiers and their families, the American judicial system would have been a long-distant memory.
Beyond the inherent injustice of the court's decision is the message it sends to the thousands of families around the country that have received a tightly wrapped flag and heard the words, "On behalf of a grateful nation ..."
When the Snyder family sued to protect the common decency we should provide to all grieving families, their efforts were met with court orders to pay the legal bills of those who caused their family so much needless pain.
Surely, this is not the kind of thing that Lance Cpl. Snyder or my son, Justin, gave their lives to protect. Has our nation learned nothing from our treatment of returning Vietnam veterans? What would have been the reaction to Fred Phelps and his repugnant actions during World War II? Our veterans and the families of those who didn't return deserve better than this.
Looking ahead, as engagements in Afghanistan draw on and our soldiers answer the call to defend freedom around the world, this case could have a dangerous effect on morale and willingness to serve.
It is time for the Supreme Court to take up this case, not only for families like Albert Snyder but for the families who will bear the ultimate price of freedom in the future. The justices should strike down the ruling of the Virginia court that brushed aside the sacrifice of Lance Cpl. Snyder and restore common sense and basic decency to the way we honor our fallen heroes.
Snyder fought on behalf of all of us, and now his father fights on his behalf. I can only hope that the Supreme Court will restore some measure of justice and dignity to a family so richly deserving of the best the United State has to offer.

The justices Monday accepted an appeal from the father of a U.S. Marine killed in Iraq over efforts to keep members of the Topeka-based Westboro Baptist Church from demonstrating near memorial services and burials. The Supreme Court will hear Snyder’s appeal this fall, 2010.

Amendment 1, I think that the family members shouldn't have to pay for the court fees after losing their family member. I think they are going against the Supreme law.

I think that the freedom of speech gives people the right to say or do what they want no matter who agrees or not. ReplyDeleteI think out of the first ten amendments the amendment in this article would be amendment one, freedom of speech, press, religion, and petition. I think that what these people did is very wrong! They are trying to bury their son that fought in Iraq in times of the war. Yeah it might be freedom of speech, but this guy was fighting for our country for freedom, and got killed. I think these protesters are harassing this family and the guy that got killed in the war. I do not think this family should have had to give any of the money back to these protesters. This family should have been able to keep every penny of the money from these protesters, even if it is amendment one (freedom of speech). This case shouldn't have to be taken to the Supreme Court in the first place! It should have closed already because of what they did. They need to realise these soldiers fight for our country and the fight for freedom! They don't go out there to mess around and get killed! They go out there for a reason! He needs to imagine when he dies what he wants to happen, does he want people with signs screaming and yelling? No, he probaly wants certain people there, and wants it at a certain place, and he probaly wants it to be peaceful! Just like everybody else wants their funeral, they want it peaceful, usually they don't care who is there as long as nobody is screaming and yelling holding up signs! It is freedom of speech and all, but what he/they did is definetly not right! I dont think they are going against the Supreme Law, but it still wasn't the right thing to do!

I do not think the Bill Of Rights (Freedom of Speech)was written to let people stand up and yell bad words, call people names, and say hateful things. Mr. Phelps can be against war and use his own time to protest war, but not at a soldiers funeral and not in a hateful way. Lance Corpral Snyders family has suffered enough and Lance Corp. Synder paid the ultimate price for freedom. They should have to pay for anything.

Fine to protest war, not wise to do it at a soldier's funeral! You don't have to be pro war to appreciate and respect this military family's sacrifice! Common sense and courtesy please!!
ReplyDeleteNot only does it go against ammendment 1 for freedom of speech, religion, and press it also challenged the ammendment that keeps you from unfair treatment and unfair fines. I think it is completely unfair for this family to have to go through this even after their son fought for our freedom over in Iraq. Why are they going back to acting the same way we did when the troops came back from Vietnam. I think they are going against are supreme law and the law of just regular common sense.

Amendment One. I think the protestors should be able to have freedom of speech but not at a funeral or a cemetary. I do not think the family should have to pay lawyers for the protestors. The protestors are not breaking the law unless they are harassing the people at the funeral. I hope the Supreme Court straightens it out.

I think the Judges are a little coo-coo in the brain. I think they forgot what our soligers are fighting for. I don't even think that they think that this case is challenging the 4th amendment trying to discuss a problem with the goverment and the 8th amendment a person is entiteled to fair and equal treatment under the law.

i think they are chalenging amendment 4 because they have a right to talk about it to the government and the govern ment should listen to them and at least pay them for a proper burial for a person who died for our country i mean would they rather have nobody going to the army, navy etc.... and nobody fighting a war for us because more people woul die if nobody was out there fighting for us a person goes to the army, navy etc... because they love there country and are willing to do anything for it. i think the way they are treating the snyder family is just plain wrong he fought for our country and died because he loved america. I think that everybody, including the Surpreme Court, should always honor the soldiers who fought and died for our country. I thought that we came to America for freeeeeeedom! But nobody cares for these fallen soldiers enough to pay them some respect! All everybody does is ignore it. But I think everbody should give all of the soldiers tribute for fighting for our country and dying for our country, but guess what. Nobody cares!!!! It makes me mad to think that people would not want liberty by not respecting fallen soldiers! They fought for our country, so they should get some respect from us citizens. That's what America is for right!? To have liberty and freedom, but all we're doing is ruining it. We're supposed to be a free country. But we don't act like it. I think that it is very sad that A church would do such a thing to a fallen soldier. I think that the soldiers are over the ocean blue risking their lives for our country. I saw on the World News that the signs were very wrong they said things such as "Thank God for DEAD Soldiers!" I just don't think it is right for Fred Phelps to be picketing at funerals. I think that they should be put behind bars, because of their hateful crimes against fallen soldiers. It is not fair for the family of the fallen soldier to have to pay the price for what their son/daughter thought was right for them. It is plain right mean for people to go to the funeral of fallen soldiers and be protesting things that say things even though in Amendment 1 it says that people can have Freedom of Speech, Press, Assembly" It doesn't mean that they can go to funerals of fallen soldiers saying things that are hate crimes just because they want to go out to war. It is the soldiers choice to go out to war or not it is still not right for the Fred Phelps and Supporters to go to funerals of fallen soldiers.

I think that people should pay taxes and respect the law but they should still have some freedom to what they would like to do. I think that even though you have to do these things you should still be able to do what you want to do. I think you should not take family members unless you have permission and that you should not have to pay taxes over these things.

I think it is ammendmant nine.People should be able to choose if they want to fight or not but then they should if the war really needed them and the president makes them.Also I don't think a family needs to pay something for there son or daughter just saying what he feels should be right and what should be done.I don't think it is right for people to go to a soldiers funneral and protest against the soldier for what he did. ReplyDeleteI think that the protester's were being VERY rude to go to a funeral (the person that they do not know) and say "Thank god for Dead Soldiers". Yes they do have freedom of speech but, that is just rude! Especially if they were really missing the loved one. The people also have freedom to hold a funeral for a loved one without someone coming and saying stuff like"Thank god for soldiers".
